Competence of Public Authorities as a Determining Factor of their Independence

The importance of public authorities is determined by their competence and the degree of independence in implementing it. Clear and unambiguous legal regulation of the activities of public authorities in implementing their competence is intended to ensure a smooth functioning of the entire state apparatus. At present, however, there are controversial aspects in the legal provisions devoted to the competence of public authorities. The article is aimed at solving these controversies. The purpose of the study is to develop the authors’ approach to the legal concept of “a public authority’s competence” and its content. Analysis into the phenomenon of public authorities’ independence reveals that it is manifested through the implementation of their competence. The authors suggest a definition for a state body, thus contributing to the science of constitutional law, ensuring the clarity of legal terminology and developing constitutional and legal analysis. A state body is defined as a normatively enshrined system of rights and obligations (powers) within the established subjects of jurisdiction and territorial jurisdiction.
