Constitutional and Legal Representation: Concept, Boundaries and Variety

The variety of forms of representation in the public-law sphere and the absence of uniform criteria for their sectoral qualification necessitate clarification of the content and boundaries of constitutional and legal representation. Despite the substantial development of the doctrine of popular representation and individual representative institutions, constitutional law still requires a systematic distinction between constitutional and legal representation proper, the representative character of public authorities, constitutional prerequisites for sectoral forms of representation, and other related legal constructions. The study aims to clarify the concept and boundaries of constitutional and legal representation and to systematize its principal varieties. The research employs formal legal, system-structural and legal-semantic methods. Constitutional and legal representation is understood as a legally established relationship between the represented subject and the representative, within which the representative, by virtue of their constitutional legal status or a public-law authority granted to them, legally expresses and/or implements the will or a publicly significant interest of the represented subject in relations falling within the subject matter of constitutional law. The article identifies criteria distinguishing such representation from adjacent public-law and sectoral constructions and substantiates a multi-criteria approach to its systematization according to the degree of constitutional normative determination of representative authority, the represented subject, the mode of emergence of representation, the organizational form of the representative function, and the sphere of its implementation. The results clarify the sectoral boundaries of constitutional and legal representation and provide a theoretical basis for further study of its individual forms.
