Experimental legislation: theoretical questions

Abstract

The article examines theoretical approaches based on the application of experimental legal regimes. This article is part of the scientific legal doctrine of experimental legislation developed by the author. The author explains in detail the concept of "regulation as an experiment" - one of the approaches in the palette of the latest regulatory technologies. The author shows that experimentation in legislation has, at the same time, a long history in different states. The article examines the concept, nature and ontology of experimental legislation. The author shows the ambiguity of this concept in the scientific literature. The article touches upon the essential characteristics of experimenting with legislation, shows the significant tasks and principles of such experimentation. The requirements for experimental legislation and the conditions for its use are also reflected in the article. The author dwells on the question of the advantages and disadvantages of applying an experimental approach to legal support. The article ends with the conclusion that the nature of the experimental legislation can be partially revealed through the articulation of the goal setting laid down in the experimental legislation (which is what the author did).
