The General Part of a Codified Act as a Normative Model of Factual Systems in Law

One of the practical manifestations of factual systems is the fulfillment of the law-making function, which is realized in the process of constructing (especially systematizing) legislation. This is of particular importance with regard to the systemic construction of a codified normative act, one of whose attributes is the identification of a general part. A systemic representation of legal facts in their interrelationships allows for the use of such concepts as factual compositions and systems. This is essential for the purposes of lawmaking, particularly the structuring of codified normative acts. Taking this into account, the main goal of this article is to substantiate the influence of a set of factual prerequisites of law on the construction of the general part of a codified normative act and its presentation as a normative model of the factual system. The approach presented in the article to the general part of a codified normative act as a normative model of the factual system allows for the consideration of such a document as a systemic formation in which the interrelation of elements is an essential characteristic. The general part of a codified normative act represents a normative model of the actual system, which enshrines in legal form a systemic representation of the actual prerequisites for legal regulation. The results of the study form a new theoretical direction in the study of problems of structuring codified normative acts.
