Basic Principles of Pandetic Codification: From Roman Law to Modern Codes

The pandectic system of organizing normative material retains its methodological significance for modern lawmaking, representing a classic example of a systemic approach to the architecture of codified acts. Despite the extensive body of scholarly works devoted to the general theory of codification, the technical and legal aspects of the structural organization of codification acts remain insufficiently developed in modern legal doctrine. Therefore, this study aims to develop a system of methodological guidelines relevant to the modern codification process which is carried out within the pandectic paradigm. The methodological basis of the work is a reconstruction of the scientific legacy of German pandecticism, which fundamentally transformed the casuistic legacy of Roman law into a coherent system of abstract logical categories in the 19th century. As a result of the study, the following principles of the pandectic construction of normative material have been systematized and conceptualized: 1) the principle of structural dualism; 2) the principle of specialization of legal norms; 3) the principle of normative economy. The theoretical significance of the study lies in the development of the doctrine of codification lawmaking in relation to contemporary challenges in legislative technology. The findings of the study can be used in the development and systematization of codified acts, ensuring their logical integrity and dogmatic consistency.
