Abstract

Today, terrorist threats are transnational in nature, while there is no single recognized legal definition of terrorism, which significantly complicates international cooperation in the field of criminal prosecution and justice. The purpose of the study is to identify the problems that arise when specific acts are determined as deeds of international terrorism, and to identify the main elements that form the international legal structure of this crime on the basis of existing conventional mechanisms. It is shown that, despite the lack of a universal definition, international law has developed consensus criteria for identifying terrorist acts, primarily through a special purpose – coercion of governments or intimidation of the population. It is concluded that further improvement of the international legal regime for countering terrorism should be aimed not only at developing a comprehensive convention, but also at strengthening existing mechanisms, in particular, at harmonizing national legislation and wider application of the principle of universal jurisdiction.
