Prospects for the Development of Preliminary Regulatory Control Exercised by the Constitutional Court of the Russian Federation

The constitutional reform of 2020 launched the processes of updating the interaction of public authorities in various fields. In the field of strengthening control over the observance and protection of the Constitution of the Russian Federation, the relationship between the President of the Russian Federation, parliamentarians and the Constitutional Court of the Russian Federation has been reviewed in connection with the implementation of constitutional judicial regulatory control. Amendments to the Constitution of the Russian Federation regarding constitutional judicial regulatory control, in addition to updating the status parameters of the domestic body of constitutional justice, indicate a significant update of the model of regulatory control, including its extension to acts of Parliament that have not entered into force. The purpose of the study is to identify the causes and problems of the implementation of the institution of constitutional judicial regulatory control, and to propose solutions. Based on the review of legislation, the main directions for improving the institution of constitutional judicial regulatory control are outlined, and the specifics of its updated regulation in a preliminary form are investigated. Despite the high protective constitutional potential, the preliminary constitutional judicial regulatory control in relation to draft laws, adopted laws before their signing, has so far never been initiated and implemented. The reasons are different, related to the improvement of the quality of laws, partly due to a negative attitude towards preliminary regulatory control, as well as incomplete regulation of its implementation. It is concluded that it is necessary to optimize certain legislative provisions related to the regulation of federal and regional legislative processes in terms of their intersection with the implementation of preliminary constitutional judicial regulatory control in the activities of the Constitutional Court of the Russian Federation.
