Protection of the Constitutional System as a Fundamental National Interest: Resources of the Judicial Power

The foundations of the constitutional system of Russia proclaimed in the first chapter of the country's Constitution set hierarchically fixed parameters of modern state building that are studied by legal science not only as a leading public law institution and an axiologically shaded phenomenon, but also as a fundamental national interest that requires appropriate protection. As a result of the amendments to the Russian Constitution in 2020, it was defined as the goal of the Constitutional Court's activities, and was also reflected in the Russian National Security Strategy, which includes all elements of the public mechanism and institutions of civil society. Though the judicial segment of public power in Russia is recognized as the most effective one, its potential in relation to the protection of the constitutional system is not fully disclosed. This article has been prepared to fill in a number of scientific and practical legal gaps. It analyzes the main areas of law enforcement activities of courts that help strengthen the foundations of statehood and ensure a balance of public and private interests. The authors substantiate the claim that effective judicial protection of fundamental constitutional values determines the stability of the Russian legal order and forms guarantees of the country's sovereignty. The conclusion is made about the importance of the preventive and stabilizing potential of the judicial power in the context of modern challenges to the constitutional system of Russia.
