The Interests of Social Actors in the Constitutions of American States

Abstract

The category of "interest" is an object of the humanities, including law. The construction of a modern legal state, civil society, and the development of personality in them depends, among other things, on the realization of the interests of all these subjects. In legal science, interest is usually considered from the point of view of the theory of law. However, there is no knowledge systematized by the constitutional branch. In this regard, it is relevant to identify foreign experience in formalizing the interests of social subjects in the constitutions of American countries on the basis of the method of comparative jurisprudence. As a result of the comparative legal analysis carried out, the diversity of their interests in correlation with individual, collective and combined social subjects has been established. The interests of individual social subjects are the most diverse. The presented species diversity of interests of social subjects of constitutional legal relations contributes to the isolation and meaningful content of the theory of interests in constitutional law.
