On the influence of moral values on the principles and norms of family law

Abstract

The article substantiates the conclusion that moral principles and norms are quite widely in demand in family legislation and actually influence the content of its basic principles and norms, thereby laying the basis for its further development and improvement. Due to this influence, the basic family (traditional) values are legally fixed, formulated in legal language, and then implemented through the norms of family law. The author proves that in relation to the majority of moral rules mediated in the norms of family law, the law itself performs a protective role, protecting family members from dangerous influences on their life or health from other family members or third parties. In turn, the norms of morality perform a regulating function, determining the daily life of the family. It is the moral values reflected in the norms of family law that make it possible to implement the educational function of family law, aimed at preserving the family, ensuring the right of the child to live and be raised in a family, and guarantee the material basis of family life.
