Защита культурных ценностей в ситуации вооруженных конфликтов

Военные конфликты первых десятилетий ХХI века грозят уничтожением памятникам древнейших цивилизаций на Ближнем Востоке, в Африке. Эта ситуация заслуживает пристального внимания как юристов-международников, так и ученых. Философами и культурологами уделяется много внимания изучению культурных ценностей, традиций, культурного наследия, мемориальной культуры; при этом не достает работ, связанных с применением знаний к анализу сложившейся социокультурной ситуации. Цель работы – показать междисциплинарный характер проблемы защиты культурного наследия в ситуации вооруженных конфликтов, значимость ее решения для культурологии как науки, важность, но недостаточность охранительно-правового подхода к защите культурного наследия. Полагаем, что при уточнении масштаба действия законов, которые обеспечивают защиту культурного наследия в контексте вооруженных конфликтов, неизменно возникают вопросы, выходящие за рамки права, но требующие неотложного решения, в том числе о необходимости и возможности сохранения духовных ценностей, культурной памяти в ситуации разрушения материального субстрата.
